立憲民主主義の危機。

９月２９日国会内の記者会見で「立憲民主主義の危機」と 大森政輔・元内閣法制局長官は断言する。
○政府は７月1日午後、首相官邸で臨時閣議を開き、集団的自衛権の行使を容認する ための憲法解釈変更を決定した。 憲憲法改正によらず、内閣の解釈だけで 自衛隊の海外での武力行使に道を開くもので、 「専守防衛」を堅持してきた戦後日本の安全保障政策は歴史的転換点を迎えた。
○この７月１日の閣議決定は、憲法９条の存在意義を失わせるだけでなく、憲法に よって政治権力を制約するという「立憲主義」を覆すものである。特定の政権 の判断で憲法解釈を自由にできるという前例を開くことは、これまで積み上げ られてきた政府の憲法解釈を根底的に変換させる。
○本閣議の論拠となっている「積極的平和主義」という安倍首相の概念は、結局の ところ、安倍首相が「正しい」と考える事態を実現するため、地理的な限定な しに自衛隊が戦闘行を行使するという事である。
